Greer Injury Lawyers Takes Legal Action Against Ohio-Based Law Firm Over Alleged Unethical Solicitation Practices

The plaintiff in the case
Ben Daniel, a practicing personal injury attorney as well as a car crash victim, is the plaintiff in the case. Daniel reportedly received a direct solicitation call from Schuerger and Shunnarah shortly after his accident. In a conversation with FOX13, Daniel noted that Tennessee’s Rules of Professional Conduct create strict ethics rules that prevent lawyers from contacting victims within 30 days. The law is meant to prohibit lawyers from putting pressure on victims shortly after they’ve endured a traumatic experience, like a severe crash.
Daniel explained that his goal is to uphold those Tennessee legal ethics and protect future victims from similar predatory tactics.
“There are laws and rules of ethics that prevent lawyers from contacting somebody within 30 days,” he told FOX13, “and the reason for that is because they are vulnerable.”
Allegations of improper solicitation
The lawsuit alleges that Schuerger and Shunnarah engage in improper and unethical solicitation tactics to solicit accident victims in Tennessee. According to the lawsuit, the Ohio firm allegedly sidestepped Tennessee’s Rules of Professional Conduct by using a third-party marketing company based in Florida. The company allegedly called recent crash victims under the pretense of helping with medical evaluations. Then, they transferred calls directly to Schuerger and Shunnarah.
